Terms of Use — Hermina Cloud
Hermina Cloud service rules. Read them before paying or unlocking access. This is a product draft for legal review, not a lawyer-stamped opinion.
Acceptance
By using Hermina Cloud, you confirm that you have read and agree to these Terms of Use and to the Privacy Policy at /privacy. If you do not agree, do not create an account, pay, or connect a messenger.
The service
Hermina Cloud is a hosted WhatsApp and Telegram AI agent (Hermes). You sign in with Telegram OAuth or an email code, choose a plan, connect a messenger, and the agent can reply, organize chats, and act in that messenger.
The Cloud inbox mirrors chats (including groups, even when the agent is off). Review-before-send is available so you can check drafts. Agent replies are labeled with the “[agente]” / “[Agent]” prefix; stealth mode was removed. Voice transcription and a cloud computer / VNC session exist on supported plans. Default model is DeepSeek V4 Flash via OpenCode Go; other providers may be configured.
Self-host is a separate distribution. These Cloud terms apply to the hosted product at cloud.artificialmanufactory.com, not to software you run yourself.
Privacy Policy
The Privacy Policy is incorporated by reference. It explains Cloud account data, third-party chat content, subprocessors, and how to ask for access or deletion. Conflicts about personal-data processing are read together with that policy.
Prompt collection
Prompts and interactions you send to Hermina may be collected and used to improve the system, response quality, and service security. Messages from third-party contacts that Hermina speaks with on your behalf are not collected or used for those improvement purposes — only Hermina prompts are.
For conversation continuity, operational session history on your instance may include chat context needed for Hermina to reply (including assist/auto mode). That operational history is not a training or product-improvement dataset.
Agent identification
Replies sent by the hosted agent keep the “[agente]” / “[Agent]” prefix so the counterpart can tell they came from the agent. Unlabeled stealth replies are not a product feature.
You warrant that you have the right to connect the messenger account and that you will make any disclosures your own contacts are owed under the law. We process counterparties’ messages to run the service; we do not claim those people are not personal data.
Acceptable use
You must not use Hermina Cloud for unlawful monitoring, to process children’s data, to spam, to jailbreak or attack the service, to run unauthorized automation that harms us or third parties, or for any other abuse.
If you abuse the system — including irregular spam, jailbreak attempts, unauthorized automation, or other conduct that harms the service or third parties — your account may be blocked. Suspensions may be reviewed upon request to support.
Payments are non-refundable
Plans are billed via Stripe and/or PIX as offered in the product. Plan payments are non-refundable if you withdraw, cancel, or stop using the service after payment is confirmed. Storage included with a plan is 1 GB per plan unless the panel shows otherwise.
Account suspension and data after termination
We may suspend or terminate access for abuse, non-payment, legal risk, or to protect the service. After termination, Cloud consumer data export is on request: ask derekoob@hotmail.com or Telegram @x_panika. There is no self-serve export API and no 30-day automated export in these Cloud consumer terms. Deleting one inbox chat is not account deletion or a full erase.
We keep instance data while the tenant exists. After termination we will delete or anonymize what we control when we process a valid request, except records we must keep by law.
Limitation of liability and governing law
The service is provided as a hosted tool. We are not a law firm, a licensed surveillance provider, or a party to your chats with third people. To the extent permitted by consumer law in Brazil, our liability for Cloud is limited to the amount you paid for the plan period in which the claim arose, and we are not liable for indirect loss, lost profit, or what a language model outputs.
These Cloud consumer terms are governed by the laws of Brazil. The courts of São Paulo, Brazil, have jurisdiction, unless a mandatory consumer forum applies.
